Mr. Gunderson concentrates his practice representing businesses, health care facilities, and other small and large employers in matters involving general business litigation, employment litigation defense, and medical malpractice defense. He also provides counsel and advice to businesses, in-house counsel, HR professionals, and executive employees in all areas of employment law, employee relations, and human resource matters.
Mr. Gunderson represents employers in a wide range of general business litigation and employment litigation matters in state and federal court, including defense of suits filed under Title VII of the Civil Rights Act of 1964 (Title VII), the Americans With Disabilities Act (ADA), the Fair Labor Standards Act (FLSA), the Family and Medical Leave Act (FMLA), and the Age Discrimination in Employment Act (ADEA), and other federal and local civil rights and employment rights statutes.
He also advises employers, large and small, on compliance with the myriad of employment laws and regulations applicable in today's workplace, including the Consolidated Omnibus Budget Reconciliation Act (COBRA), the Health Insurance Portability and Accountability Act (HIPAA), the federal plant closing statute (WARN), and the Uniformed Services Employment and Reemployment Rights Act of 1994 (USERRA). He also has worked closely with companies advising them on reductions in force, litigation avoidance, investigating misconduct and corporate non-compliance, and limiting liability in all aspects of employment decisions, from hiring to discharge. He has worked with clients in developing and revising company policies and employee handbooks, including developing anti-discrimination and anti-harassment policies, drug and alcohol testing policies, family and medical leave policies, overtime policies, and non-compete and confidentiality agreements.
Mr. Gunderson also advises and represents executive and upper-management employees in matters of hiring, discharge, negotiation of terms of separation and severance, non-compete and confidentiality matters, and executive compensation agreements.
Prior to joining F&G, Mr. Gunderson was an associate attorney with a Baltimore firm as a member of their Labor and Employment Group, specializing in employment litigation defense on behalf of both public and private sector employers.
